Terms of Service

These Terms of Service ("Terms") are a binding legal agreement between you ("User," "you," or "your") and The Leo King, Inc., a California corporation located at 18650 MacArthur Blvd. STE 360, Irvine, CA 92612 ("Company," "we," "us," or "our"). The agreement covers SpiritDial.ai and any associated premium products, subscriptions, credits, or free features (collectively, the "Services"). David Lawrence Palmer is an officer of the Company and protected under these Terms. Accessing or purchasing Services constitutes acceptance; if you disagree, do not use the Services.

1. Description of Services

The Services deliver spiritual, astrological, and psychic insights through AI-powered interactions, including text chat, voice sessions, and audio readings. Content is for entertainment and spiritual guidance only; it is not medical, legal, financial, therapeutic, or professional advice. We make no guarantees of accuracy or outcomes, and you assume all risk.

2. User Eligibility and Conduct

• You must be at least 18 years old.
• Provide truthful information and refrain from impersonating others.
• Prohibited conduct includes sharing/reselling premium content, uploading malware, harassing users, or violating any laws.

3. Partner Photo Analysis Feature

Our Partner Photo Energy Reading feature allows users to upload photographs for AI-generated spiritual analysis. By using this feature, you acknowledge and agree to the following:

• Consent Responsibility: You represent and warrant that you have obtained proper consent from any individual whose photograph you upload, or that you have the legal right to submit such photograph for analysis.
• No Facial Recognition: Our system does not perform facial recognition or identity matching. Analysis is based on generalized spiritual and energetic interpretation only.
• Transient Processing: Uploaded photographs are processed transiently for the purpose of generating your reading and are not permanently stored on our servers after processing is complete.
• Entertainment Purpose: All photo analysis results, including aura readings, soul origin detection, compatibility assessments, and any other interpretations are generated by AI for entertainment and spiritual exploration purposes only. Results are not scientifically validated and should not be used to make decisions about relationships, health, safety, or any other matters.
• No Defamation: You agree not to use photo analysis results to defame, harass, stalk, or otherwise harm any individual depicted in uploaded photographs.
• Indemnification: You agree to indemnify and hold harmless the Company Parties from any claims arising from your upload of photographs without proper consent or your misuse of analysis results.
• Prohibited Content: You may not upload photographs of minors, explicit content, or any content that violates applicable laws. We reserve the right to refuse processing and terminate accounts for violations.

4. Intellectual Property

All content, algorithms, trademarks (including "SpiritDial" and "Lady Avalon"), and related content are owned by the Company Parties or licensed to us. You receive a limited, non-exclusive, non-transferable license for personal use only. No reproduction, modification, or commercial use without written consent; violations trigger indemnity obligations (see Section 8).

5. Payments, Refunds, and Chargebacks

• Payments are processed through third-party providers (e.g., Stripe); you authorize all charges.
• Subscriptions renew automatically until canceled.
• Refunds are evaluated case-by-case for undelivered digital goods caused by technical faults. Accessed content is non-refundable.
• Chargebacks on fulfilled orders constitute breach and may result in suspension, collections, and recovery of all associated costs.

6. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT RESPONSIBLE FOR ERRORS, VIRUSES, OR THIRD-PARTY LINKS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOST PROFITS OR DATA), EVEN IF ADVISED OF THE POSSIBILITY. TOTAL LIABILITY IS CAPPED AT THE GREATER OF (A) AMOUNTS YOU PAID IN THE LAST 12 MONTHS OR (B) $100.

8. Termination

We may suspend or terminate access at any time for violations or other reasons. You may discontinue use at any time. Sections regarding intellectual property, disclaimers, liability, and indemnity survive termination.

9. Indemnification

You agree to indemnify and hold harmless the Company Parties from all claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Services, breach of these Terms, infringement of third-party rights, or unauthorized sharing of content.

10. Governing Law and Disputes

These Terms are governed by California law. Disputes are resolved via binding arbitration in Irvine, CA, under AAA rules. Class actions and jury trials are waived.

11. Miscellaneous

• Force Majeure: No liability for delays caused by events beyond our control.
• Severability: Invalid provisions are reformed to reflect the original intent.
• Amendments: We may update these Terms; continued use constitutes acceptance.
• Entire Agreement: These Terms supersede all prior agreements.
